Pres Nixon's counsel J Fred Buzhardt Jr, formerly Pentagon gen counsel, told Sen Armed Services Com in testimony taken Mar 7 that he had recommended against any criminal prosecution in mil spying incident involving White House and Pentagon in late '71; Buzhardt said he had urged then-Defense Sec M R Laird not to seek charges either against Yeoman 1/C Charles E Radford, clerk then assigned to White House who was suspected of leaking highly classified documents to columnist Jack Anderson, or against Rear Adm Robert O Welander, named by Radford in subsequent interrogation as participant in funneling of Natl Security Council documents from office of Henry A Kissinger to Pentagon; Buzhardt explained that he was against Radford's prosecution because of fears that Govt's case could not be won; minimizes case against Welander; suggests Joint Cs/S Chmn Adm Thomas H Moorer had no basis for knowing that any of materials he recd had been provided illegally (M)
