INQUIRY ON MIAMI HALTED BY A SUIT; News Notes Demanded Wiretap Order Challenged--Newsmen Subpoenaed

inquiry into alleged corruption in Dade County, Fla, cts and local govt has been halted, at least temporarily, by legal action in Tallahassee; halt will be in effect until Fla Sup Ct rules, probably early next wk, on suit challenging legality of wiretap on which yr-long inquiry has been primarily based; also next wk, several local newsmen will ask US Dist Ct to quash subpoenas served on them; subpoenas call on newsmen to produce their notes on inquiry into alleged 'fixing ct cases and zoning bd cases'; inquiry was begun secretly last yr by Sheriff E W Purdy and Miami Police Chief B Garmire; has centered on activities of F Martin, 71-yr-old service station owner who is reputed to have considerable pol influence; police informer worked for almost yr at Martin's gasoline station, which is frequently visited by local judges and elected officials; Purdy and Garmire, acting on information provided by informer, requested 2 wiretaps on Martin's telephone; taps were authorized by Sup Ct Justice J Adkins and Gov R Askew; early in Feb, news about investigation reached public when newspaper articles and special TV shows gave many details; Askew, reptdly angered by disclosures, named special out-of-town investigator, Volusia County State Atty S Boyles; inquiry has also been transferred to jurisdiction of Volusia grand jury; Miami Mayor D Kennedy and F Cobo, his adm asst, who have recd wiretap notices, filed suit in Tallahassee challenging under Fla law constitutionality of Adkins's wiretap authorization; Volusia Chief Judge J Nelson, advised that Fla Sup Ct had accepted suit, instructed Boyles to suspend investigation; lawyers for Rev T Wright, also recipient of wiretap notice, will go to ct next wk seeking temporary restraining order to prevent public release of further information about inquiry; 5 reporters for The Miami Herald and 2 TV reporters have been subpoenaed in case; D Paul, atty for Herald reporters, indicates that reporters will not surrender their notebooks and tapes
